Registration date: January 7, 2020 The commercial name "HoHoHo Video" refers to the service provided by the above entity. Contact email: contact@hohohovideo.com

1. These Terms & Conditions define the rules of using the HoHoHo Video service. 2. The service consists of creating a personalized digital video based on a photo submitted by the Customer. 3. Placing an order constitutes full acceptance of these Terms & Conditions. 4. The service is provided exclusively online and delivered in digital form.

● Service – the creation of a personalized video using AI based on the Customer's photo. ● Customer – the person placing the order and paying for the Service. ● Customer Materials – photos or other content submitted by the Customer. ● Video – the final digital file delivered to the Customer.

1. The Customer uploads a photo via the order form. 2. Based on the photo, a personalized entertainment video featuring Santa Claus is created using AI technology. 3. The video is fictional and does not represent real events. 4. The final result may vary due to the nature of AI and the quality of the submitted photo. 5. The Service Provider may, at its discretion, refuse an order that violates these Terms.

1. The Customer declares they have the legal right to use the submitted photo, including permission from guardians of minors visible in the image. 2. The Customer must not upload photos containing: ○ illegal content, ○ nudity or sexual content, ○ violence or offensive gestures, ○ third-party copyrighted characters, ○ content infringing rights of others. 3. If such content is submitted, the Service may be cancelled. If production has already started, no refund applies.

1. Standard delivery time is up to 24 hours after payment. 2. During high demand or technical disruptions, delivery time may be extended. 3. The Service Provider may temporarily suspend new orders in case of capacity limits.

1. The final video is delivered via a download link sent to the email provided in the order. 2. The Customer is responsible for providing accurate contact details. 3. If the email is not received, the Customer may request a resend at contact@hohohovideo.com.

1. The service is paid in advance. 2. Payments are processed securely via Stripe Payments Europe, Ltd. 3. The Service Provider does not store or process payment card details. 4. Payment disputes or chargebacks are handled through Stripe procedures.

1. By placing an order, the Customer expressly agrees to immediate start of the Service before the 14-day withdrawal period expires. 2. The Customer acknowledges that the Service: ○ is digital, ○ is custom-made and personalized, ○ is delivered electronically, ○ cannot be returned once delivered. 3. According to EU consumer law (Article 38 Polish Consumer Rights Act), no right of withdrawal applies once production begins. 4. No refunds are available after the video has been delivered. 5. Refunds may only be issued if: ○ the video is not delivered at all, or ○ the delivered file is technically corrupted and unviewable.

1. Complaints must be submitted within 7 days of receiving the video. 2. A complaint must include name, email, and issue description. 3. Complaints are handled within 7 business days via contact@hohohovideo.com.

1. The Customer retains rights to the submitted photo. 2. The Customer receives a non-exclusive license for personal use of the video, including sharing with family or on social media. 3. The video may not be sold or used commercially without written consent. 4. Marketing Use: By placing an order, the Customer grants the Service Provider the right to use the final video and/or submitted image for marketing and promotional purposes, including social media and advertising, unless the Customer explicitly requests exclusion in writing via contact@hohohovideo.com prior to or immediately after delivery. 5. If minors appear in the video or image, the Customer confirms they have the authority to grant this permission.

1. Photos and generated videos are stored only for the time necessary to deliver the Service and may be deleted after 30 days. 2. Personal data is processed solely to fulfill the order. 3. Details are governed by the Privacy Policy.

1. The Service is entertainment-only and does not depict real events. 2. The Service Provider is not responsible for: ○ poor-quality input photos affecting results, ○ inability to view the video on the Customer's device, ○ consequences of sharing the video publicly. 3. Total liability is limited to the amount paid for the Service.

1. Placing an order constitutes acceptance of these Terms & Conditions. 2. The Service Provider may update these Terms at any time. 3. Matters not regulated are governed by Polish law.
